The petitioners seek bail in connection with Special Case No.7905 of 2021 arising out of P.R. Agamkuan P. S. Case No.35 of 2021, instituted for the offences under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Excise Act, 2018. The learned counsel for the petitioners submits that the petitioners are in custody since 28.11.2021, they are persons with clean antecedent and prosecution report has been submitted in the case.

Allegation is of recovery of 480.00 litre of liquor from an auto.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and prosecution report has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.7905 of 2021 arising out of P.R. Agamkuan P. S. Case No.35 of 2021.

The application stands allowed.
