Petitioner is accused in connection with Neemchak Bathani P.S. Case No. 86 of 2014 registered under Sections 341, 323, 324, 307 and 302 of the I.P.C.
The accusation is that due to dispute of partition of land, Dilip Yadav gave knife blow at the back of Dhananjay Yadav, son of the informant, who fell down. Thereafter, petitioner Arvind Yadav and Deonandan Yadav caused injury to him through legs and slaps, as a result of which, Dhananjay Ydav died in course of treatment.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the occurrence took place due to land dispute and there is only allegation against the petitioner to cause injury to the deceased
Patna High Court Cr.Misc. No.27195 of 2015 (3) dt.07-10-2015 2/2 through legs. The specific allegation to give garasa blow to the deceased is against Dilip Yadav. It is also submitted that petitioner is in custody since 17.02.2015 and have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gaya in connection with Neemchak Bathani P.S.
