2. Petitioner seeks regular bail in connection with Vaishali P. S. Case No. 260/2024 in a case registered for the offence punishable under Sections 467, 468, 471, 420, 12(B) of the Indian Penal Code.

3. Prosecution case, in brief, is that in the year 2016, this petitioner and Arvind Kumar had contested in election for the post of Ward Member of Gram Panchayat, Jarang Rampur wherein this petitioner won the election and Arvind Kumar lost. Thereafter, in the same year, Ward Sachiv was selected in Ward No. 9. Informant alleges that this petitioner and Ward Secretary in collusion with each other selection Rakesh Kumar as Ward Sachiv and intentionally deleted the name of Arvind Kumar in

Patna High Court CR. MISC. No.14336 of 2025(2) dt.18-04-2025 2/2 place of Rakesh Kumar.

Learned counsel for the petitioner submits that as per F.I.R., occurrence is of the year 2016 and F.I.R. has been lodged in the year 2024, after lapse of more than eight years which itself raised doubt over veracity of the prosecution case. Petitioner is in custody since 24.11.2024. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Vaishali P. S. Case No. 260 of 2024.
