Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 120B, 332, 323, 324, 353, 307 of the Indian Penal Code.
It is alleged that Ganarur Rai, was caught by informant and brought to police station. Thereafter, this petitioner along with other supporter pressurize the police to release the Ganarur Rai. On refusal the petitioner along with other supporter blocked the road and pelted stones on police force, causing them injuries.
Learned counsel for the petitioner submits there is no specific allegation and allegation of assault is general and
Patna High Court CR. MISC. No.11414 of 2023(3) dt.01-05-2023 2/2 omnibus against this petitioner. The petitioner has been made accused only due to village politics in this case. Similarly situated co-accused persons have already been allowed prearrest bail by a Co-ordinate Bench of this Court vide Paragraph 14 of the bail petition.
Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-12th, East, Muzaffarpur in connection with Sakra P.S. case no. 106 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
