The present writ application has been filed for a direction to the respondent authorities to consider the application of the petitioner for taking action against respondent nos. 8 to 11, who have forcibly demolished the boundary wall of the purchased land of the petitioner appertaining to Old Khata No. 150, Old Plot No. 376, situated in Sultanganj, District - Bhagalpur. It is submitted by learned counsel for the petitioner that the
Patna High Court CWJC No.19192 of 2017(2) dt.12-02-2018 2/2 petitioner submitted an application for taking action against private respondent nos. 8 to 11 before the respondent no. 7, Officer-in-Charge of Sultanganj Police Station, respondent no. 6 Circle Officer, Sultanganj, respondent no. 3 Senior Superintendent of Police, Bhagalpur, respondent no. 2 District Magistrate, Bhagalpur and D.I.G, Eastern Range, Bhagalpur as contained in Annexure 5 series but no action has been taken, as yet.
Considering the nature of dispute and the nature of prayer made, this writ application is disposed of with a direction to the respondent no. 2, the District Magistrate, Bhagalpur and respondent no. 3, the Senior Superintendent of Police, Bhagalpur to dispose of the representation of the petitioner in accordance with law within a period of six weeks from the date of receipt/production of a copy of this order. It is made clear that this Court has not expressed any opinion with regard to the claim of the petitioner over the land in question.
