The petitioner seeks bail in connection with Barh P. S. Case No. 176 of 2014 registered under Sections 25(1-B)(a) and 26 of the Arms Act.

According to the prosecution case, a country-made loaded pistol and a cartridge are alleged to have been recovered from the possession of the petitioner.

The prayer for bail of the petitioner was rejected by this Court, vide order dated 9.9.2014 with observation that if the trial is not concluded within a period of six months, the petitioner would be at liberty to renew his prayer for bail. It is contended that though the petitioner is in custody

Patna High Court Cr.Misc. No.31279 of 2015 (3) dt.07-10-2015 2/2 since 20.5.2014, no witness has been examined on behalf of the prosecution so far.

It would appear from the report submitted by the Jurisdictional Magistrate, Barh that the charges were framed against the petitioner on 03.08.2015.

Learned counsel for the State has opposed the prayer for bail.

Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar, learned Judicial Magistrate, 1st Class, Barh in Barh P. S. Case No. 176 of 2014.
