JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-05-2018 The learned counsel for the petitioner draws the attention of this Court to the order dated 21.02.2017 passed by the Court of Commissioner, Tirhut Division, Muzaffarpur in Service Appeal no. 215 of 2016, whereby and whereunder the case of the petitioner has been remanded back to the District Magistrate with a direction to decide the case of the petitioner afresh, considering the grounds raised by the petitioner in the appeal, filed before the learned Court of Commissioner.It is submitted that the District Magistrate till date, has not decided the

Patna High Court CWJC No.9222 of 2018 (2) dt.14-05-2018 2/2 case of the petitioner.

In view of the aforesaid, the present writ petition is disposed of with a direction to the District Magistrate, Vaishali to pass a final order in the pending case of the petitioner within a period of six weeks from today after granting an opportunity of hearing to the petitioner herein. The District Magistrate shall consider the fact that the petitioner has stood retired on 30.04.2018.
