JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 A counter affidavit has been filed by the respondent-State, which is taken on record. Apart from the said counter affidavit, an order dated 15.07.2021, passed by the Circle Officer, Wazirganj, Gaya in connection with Encroachment Case No. 2 of 2020-21, has also been produced, which has also been taken on record. A copy of the said order dated 15.07.2021,has also been handed over to the learned counsel for the petitioner, who seeks liberty to challenge the same by filing

Patna High Court CWJC No.16073 of 2017(3) dt.09-05-2023 2/2 appropriate appeal, however, submits that some protection be granted during the interregnum period.

Accordingly, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioner to challenge the aforesaid order dated 15.07.2021, by filing appropriate appeal and in case such an appeal is filed, within a period of four weeks from today, the same shall be considered on merits by the appellate authority and a reasoned and a speaking order, in accordance with law, shall be passed, forthwith and till then status quo existing as on today, qua the land/house of the petitioner in question shall be maintained.

The writ petition stands disposed off.
