JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Learned Additional Public Prosecutor who has submitted the report addressed to Principal Additional Advocate General by the Superintendent of Police, East Champaran at Motihari wherefrom it is apparent that all the prosecution witnesses have already been examined. That being so now the ball has gone to the court of petitioner.

Because of the fact that there happens to be recovery of 3 kg charas from the possession of the petitioner, on account of I do not see any cogent reason that too when examination of all the prosecution witnesses have completed, to reconsider. Prayer for bail is rejected. However, learned lower court is directed to expedite the trial and conclude the same within three months.
