This application, for grant of anticipatory bail, arises out of Madhaurah Police Station Case No. 496 of 2018, disclosing offences under Sections 399/402 of the Indian Penal Code and Sections 25 (1-B)A/26/35 of the Arms Act. The allegation against the petitioner is that the police raided near the mango orchard, from where three persons were arrested on the allegation that they were preparing to commit some serious crime, and this petitioner along with others succeeded in fleeing from the orchard.

Learned Counsel for the petitioner submits that the petitioner has no criminal antecedent and he has been named in

Patna High Court CR. MISC. No.12201 of 2019(4) dt.27-06-2019 2/3 the First Information Report by the police. The police has recovered arms and ammunition from the possession of the arrested accused persons.

Learned Additional Public Prosecutor, after referring to paragraph 5 of the case diary, has submitted that the arrested accused persons have disclosed the name of some of his accomplices, but did not disclose the name of the petitioner. After having heard learned Counsel for the parties and considering the fact that the arrested accused persons have not disclosed the name of the petitioner as one of their accomplice, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VIII, Saran, at Chapra, in connection with Madhaurah Police Station Case No. 496 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to
