JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-07-2023 The present petition has been filed to renew the prayer for grant of anticipatory bail to the petitioner which was earlier rejected vide order dated 14.12.2021 passed in Cr. Misc. No. 15300 of 2021.

It is alleged against the petitioner that he assaulted the father of the informant on his head, as a result of which, he fell down and received head injury. It is submitted by learned counsel for the petitioner that similarly situated co-accused Anil Ram has been granted privilege of anticipatory bail vide order dated 28.09.2022 passed in Cr. Misc. No. 48236 of 2022.

No.10453 of 2023(2) dt.05-07-2023 2/2 Considering the fact that anticipatory bail of the petitioner was rejected on the ground that he had assaulted the father of the informant on his head and no new ground has been raised by the learned counsel for the petitioner to take a different view in the matter, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of bail to the petitioner stands rejected.

The petitioner is directed to surrender before learned Court below within a period of four weeks from today and pray for regular bail which may be considered by the learned Court below without being prejudiced by the order of this Court.
