1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Akbarpur Town Police Station Case No. 81 of 2023, dated 05.02.2023, disclosing offences under Section 341 323, 307, 379, 34 of the Indian Penal Code.

3. The prosecution story, as per the First Information Report, is that the informant has a shoe shop at Chatar Halt, in which, his brother used to sit. On the date of occurrence, while the informant's brother was sitting at the shop, one Niranjan Singh, resident of Shakarpura came and asked his brother for extortion and on protest, he called 8-10 persons from

It is alleged that co-accused Niranjan Singh gave iron rod blow on the informant, due to which, he sustained head injury, co-accused Bajrangi Kumar took away Rs. 2,000/- from the cash box of the shop and Chandan Kumar gave shovel (Belcha) blow on the person of informant's brother, due to which, he sustained injury on his finger. It is further alleged that co-accused Niranjan Singh fled away after making firing in air.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to previous enmity, grudge and local dirty politics. Allegation against the petitioner is general and omnibus in nature. He next submits that as per the FIR, allegation against the petitioner is that he gave iron blow but it is not clear that upon whom, the blow was made. He also submits that injury described in the impugned order is not on the vital part of the injured. Petitioner is in custody since 08.12.2024.

5. Regards being had to the submissions made by the parties and taking into consideration the nature of allegation and the fact that the petitioner is having no criminal antecedent and the he is in custody since 08.12.2024, accordingly, I am

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection to the Akbarpur Town Police Station Case No. 81 of 2023, dated 05.02.2023

8. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
