JUSTICE PRABHAT KUMAR JHA ORAL ORDER 11-05-2015 Heard learned counsel for the petitioners, the informant and learned APP.

The petitioners seek their bail in a case registered under Section 302 and other sections of the IPC.

The father of the deceased suspected that the petitioners kidnapped his daughter and after killing her, thrown her dead body in a well.

There appears that there is no eye witness of the

Patna High Court Cr.Misc. No.34808 of 2014 (5) dt.11-05-2015 2/2 occurrence. Kundan Paswan, one of the petitioners, was apprehended and he confessed his guilt. It has come that Kundan Paswan had got love affaires with the deceased, who is said to have gone to the house of Kundan Paswan but there appears that further material is collected to show that the petitioners killed the victim and thrown her dead body in a well. The doctor has found that the victim died due to asphyxia. Kundan Pawan also did not confess that the victim was kidnapped by him and he killed her. Considering the facts aforesaid, the petitioners, named above, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kahalglaon P.S.Case No.100 of 2014.
