Petitioner is accused in connection with S. Tr. No. 98 of 2015 arising out of Kowakola P.S. Case No. 43 of 2014 registered under Sections 304(B)/ 201 of the I.P.C. The accusation is of killing of sister of the informant by her husband and in-laws due to non-fulfillment of demand of dowry by putting kerosene oil on her body and disposed of the dead body.

Learned counsel appearing on behalf of the petitioner submits that petitioner is husband of the deceased and from the wedlock, he has three children. As such, no question arises about making demand of dowry. In fact, the deceased, wife of the petitioner, committed suicide herself by burn injury due to quarrel in the family. The witnesses in paragraphs no. 6 and 7 have also

Patna High Court Cr.Misc. No.27304 of 2015 (3) dt.07-10-2015 2/2 stated about committing suicide herself by the deceased. It is also submitted that police has submitted charge-sheet after investigation under sections 306 and 201 of the I.P.C. Further, it is submitted that petitioner is in custody since 22.12.2014. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Adhoc Addl. Sessions Judge,-IInd, Nawada in connection with Sessions Trial No. 98 of 2015, G. R. No. 933 of 2014 arising out of Kowakola P.S. Case No. 43 of 2014.
