The petitioner seeks bail in Patahi P.S. Case No. 111/2018, instituted for offences under Section(s) 342, 326, 354(A), 354(C), 376, 511, 504 and 506/34 of the Indian Penal Code read with Sections 66(A) and 66(C) of I.T. Act. Learned counsel for the petitioner has submitted that petitioner is Bhabhi of informant.
It is alleged in the written report that on the date of occurrence this petitioner called the informant at her house and gave some intoxication to her due to which she became unconscious. Thereafter, Munna Sah attempted to do indecent act with her. The petitioner took photograph of informant in her mobile and put the same on Whats app to defame her.
Patna High Court Cr.Misc. No.8419 of 2019(2) dt.13-02-2019 2/2 Learned counsel for the petitioner has submitted that petitioner is lady. There is no allegation of specific overt act against this petitioner.
Petitioner is in custody since 18.11.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 8th, East Champaran, Motihari in connection with Patahi P.S. Case No. 111/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
