The claim of petitioner is that the petitioner was appointed as Panchayat Sewak on 24.01.1986 in the office of Block Development Officer, Dhanarua, District-Patna and after serving at various places, he was compulsorily retired by way of punishment vide order dated 16.07.2015. The said order was

3. Learned counsel for the petitioner submits that petitioner has been paid GPF amount during pendency of writ application, however, pension and other retiral dues viz, gratuity, leave encashment, group insurance and salary for a certain period has not been paid to the petitioner as yet.

4. A counter affidavit has been filed on behalf of Respondents No. 6 to 8 i.e., the District Magistrate, Patna and other respondents stating therein that Respondents/authorities are taking needful action for the payment of due amount of the petitioner for which he is legally entitled.

5. Learned counsel for the State submits that two months' time may be granted to the State to take necessary steps for payment of admissible dues to the petitioner.

Having heard learned counsel for the parties and in view of the stand taken by the State that the payment of the admissible retiral dues of the petitioner shall be paid within a period of two months, Respondents No.6 and 8 i.e., District Magistrate, Patna as well as Block Development Officer, Phulwarisharif are, hereby, directed to take necessary steps to pay admissible dues towards retiral benefits of the petitioner within a period of three months from the date of

7. Accordingly, with the aforesaid observation and direction, the present writ application stands disposed of.

8. So far as claim of the interest upon delayed payment of GPF amount after sanction by the competent authority is concerned, the petitioner is given liberty to file a representation before the Provident Fund Officer, Patna within a period of two weeks and if such representation is filed, the same shall be disposed of in accordance with law.
