2. The petitioner seeks bail in Sahebganj P.S. Case No. 271 of 2021, registered for the offence punishable under Sections 341, 323, 307, 302, 120B and 34 of the Indian Penal Code.

3. Earlier, the bail petition of petitioner was rejected, vide order dated 07.03.2023 passed in Cr. Misc. Nos. 70008 of 2021.

4. It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner has renewed his prayer for grant of bail on the ground that co-accused Neeraj Sah, who is having similar allegations, has already been granted bail vide order dated 14.09.2022 passed in Cr. Misc. No. 36658 of 2022.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the period of custody, claim based on parity and tardy progress of trial, the prayer for bail of petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Muzaffarpur, in connection with Sahebganj P.S. Case No. 271 of 2021.
