The petitioner is accused in connection with Sessions Trial No. 2381 of 2014 arising out of Sonbarsa Raj P.S. Case No. 119 of 2013 registered under sections 302, 303, 307/34 of the I.P.C. and section 27 of the Arms Act pending in the Court of Additional Sessions Judge, IInd, Saharsa.
The learned counsel appearing on behalf of the petitioner submits that prayer of the petitioner along with coaccused Bilash Yadav for bail was rejected for the present on 21.04.2014 by this Court vide Cr. Misc. No. 4413 of 2014 with Cr. Misc. No. 4059 of 2014, while three others were allowed bail taking into consideration the nature of allegation against them. Further submission is that the case of petitioner is at present pending for prosecution evidence and only four witnesses have
Patna High Court Cr.Misc. No.27260 of 2015 (3) dt.07-10-2015 2/2 been examined till date. It is also submitted that petitioner is in custody since 18.09.2013.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
However, Trial Court is directed to conclude the Trial expeditiously by taking effective steps preferably within one year.
