IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.34678 of 2014 Arising Out of PS.Case No. -122 Year- 2013 Thana -MARAUNA District- SUPAUL ====================================================== Khakhan Nayak .... .... Petitioner/s

Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Uday Chand Prasad For the Opposite Party/s : Mr. Chandra Bhushan Pd.(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-01-2015 Heard both sides.

The petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. There is very specific allegation against the petitioner that he assaulted his daughter-in-law with Dabia (sharp cutting weapon).

Learned counsel for the petitioner has submitted that the deceased was of dubious character. The husband was living out side the house and the deceased was found in dubious condition and that is why the petitioner in a sheet of anger killed his daughter-in-law.

Considering the fact that the petitioner has killed his daughter-in-law at the spot, I am not inclined to enlarge the petitioner on bail. The same is rejected.

Patna High Court Cr.Misc. No.34678 of 2014 (3) dt.21-01-2015 2/2 The learned court below who is in seisin with the case is directed to commit the case to the court of session and on such commitment the learned trial court is directed to make all effort to conclude the trial within one year from the date of framing of charge.
