The petitioner is accused in connection with Chapra Town P.S. Case No. 316 of 2014 registered under Section 420, 467 and 471 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
The police apprehended the petitioner and one Bhisan Rai @ Bishan Rai. On search, each were found in possession of one loaded country made pistol and one live cartridges. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody sinc 23.10.2014. It is further submitted that co-accused, Bishan Rai @ Bisham Rai, has already been granted privilege of bail by a Bench
Patna High Court Cr.Misc. No.27325 of 2015 (3) dt.07-10-2015 of this Court vide order dated 27.08.2015 passed in Criminal Misc. No. 28713 of 2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No. 316 of 2014. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
