JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Konch P.S. Case No. 58 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is of killing of Rekha Devi, daughter of informant, Ram Badan Paswan, by her husband and in-laws due to no fulfillment of demand of gold chain. . Learned counsel for the petitioners submits that marriage of Rekha Devi, daughter of informant, was performed with Sudhir Paswan, son of petitioner no. 1 about 14 years ago and

Patna High Court Cr.Misc. No.29053 of 2015 (3) dt.07-10-2015 out of the wedlock two children, aged about 5 and 7 years, were born. It is further submitted that daughter of informant died due to diarrhea and her funeral ceremony was performed but due to ulterior motive this false case has been lodged. It is further submitted that petitioner nos. 1, 2, 3 and 4 being father-in-law, mother-in-law and brother-in-law of the deceased, respectively, are in custody since 15.03.2015.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Konch P.S. Case No. 58 of 2014.
