JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 406,420,467 and 468 of the Indian Penal Code.

Allegedly, the informant being the adviser of the policy of O.C.P.C. Company persuaded the informant and others and the informant and others got deposited amounts for the period of ten years. The first premium was paid and receipt thereof was granted but bond papers and original receipts were not supplied. Though the deposit was made in the year 2007-08 but the bond could not be dispatched even in 2011. The informant put his problem there

Patna High Court Cr.Misc. No.25211 of 2015 (3) dt.07-10-2015 in the meeting but he was driven out without being redressed and thus it is alleged that an amount of Rs.80,000/- was misappropriated by cheating.

Submission is of false implication and that the other coaccused, Ashish Ghatak, has been granted bail vide B.P. No.255 of 2012 and the case of the petitioner stands on similar footing to which the learned A.P.P. opposes by submitting that the case of the petitioner is on different footing and further he has got criminal antecedent and he is involved in other 22 cases. Considering the criminal antecedent of the petitioner and the allegations attributed against him, this Court is not inclined to enlarge the petitioner on bail at present and accordingly his such prayer stands rejected.
