JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-10-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner wants to renew his prayer for bail which was earlier rejected thrice by this Court vide Cr. Misc. Nos. 24648 of 2012 by order dated 10.10.2012, 8812 of 2013 by order dated 11.09.2013 and 33608 of 2014 by order dated 20.08.2014 on the ground that two witnesses are still to be examined and the petitioner is suffering in custody since 13.11.2011 for the alleged recovery of 500 grams of Heroin, whereas, co-accused Munilal Singh has been allowed bail by order dated 15.10.2012 vide Cr. Misc. No. 35970 of 2012.

The learned A.P.P. opposes prayer for bail by

Patna High Court Cr.Misc. No.25312 of 2015 (3) dt.07-10-2015 2/2 submitting that the trial is likely to be concluded. In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail of the petitioner again prayer for bail of the petitioner stands rejected in connection with Dehri (Town) P.S. Case No. 605 of 2011 pending in the court of Additional District & Sessions Judge, IVth, Rohtas, Sasaram.

However, the trial court is directed to expedite the trial in the light of the earlier orders dated 11.09.2013 and 20.08.2014 preferably within three months, failing which the petitioner may be at liberty to renew his prayer for bail in the court below itself.
