2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 324, 307, 354, 504, 34 of the Indian Penal Code.
3. As per F.I.R., this petitioner is alleged to have assaulted father-in-law of informant with iron rod, due to which, he received injury on his left shoulder.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, co-accused Abhiratan Chaudhary assaulted husband of informant with sword, causing grievous injury. So far as petitioner is concerned, he is alleged to have assaulted father-in-law of informant, but there is no injury report on record. As a matter of fact, dispute over drainage led to an occurrence, in which, there was free-fight between the parties.
Patna High Court CR. MISC. No.8292 of 2025(2) dt.06-03-2025 2/2 F.I.R. has been lodged after a delay of two days without any plausible explanation of delay.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 131 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
