JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 04-01-2018 Inter alia contending that there is encroachment on land detailed in the writ petition and certain persons have encroached upon the Government land causing inconvenience to the villagers in question and in spite of representations being submitted before the Circle Officer, Adapur, East Champaran, Motihari (respondent no.5) no action is being taken, accordingly, seeking removal of the encroachment, this petition has been filed in Public Interest.
Keeping in view the grievance made by the petitioner, as indicated hereinabove, it is directed that on the petitioner's filing of the certified copy of this order along with a
Patna High Court CWJC No.72 of 2018 (2) dt.04-01-2018 2/2 detailed complaint/representation before respondent no.5, respondent no.5 shall register the case, as an encroachment proceedings, under Bihar Public Land Encroachment Act, notice all concerned, hear them and after following the due process of law pass appropriate order with regard to removal of encroachment. The entire exercise in this regard should be completed within a period of six months from the date of submission of the representation by the petitioner.
