JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2018 The petitioner is apprehending his arrest in connection with Matihani P.S. Case No. 101 of 2013, registered for offences punishable under Sections 392 of the Indian Penal Code. Allegation as per F.I.R that mobile and other articles of the informant was snatched and this petitioner was using the Sim of the said mobile and it also appears that he is an accused in four other cases.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and there is no recovery from his possession. Further submission is that though he is accused in four other cases but in all those cases, he has already been acquitted Heard learned APP also.
Patna High Court Cr.Misc. No.28282 of 2018 (2) dt.17-05-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of accusation, I am not inclined to grant the privilege of anticipatory bail. This application is, accordingly, dismissed.
However, the petitioner, if so desire may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below shall dispose of the same on the merit of the case, without being prejudiced by the order of this court.
