JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kharagpur P.S. Case No. 10 of 2013 registered for the offence punishable under Sections 20, 21, 22, 25 of Narcotic Drugs & Psychotropic Substances Act.

Allegedly, during raid from the house of the petitioner 10 plants of Ganja were found grown up in the courtyard and the petitioner is in custody since 02.08.2015.

Submission is of false implication and that similarly situated co-accused Pankaj Singh and Makeshwar Singh have already been allowed bail vide Cr. Misc. No. 44645 of 2015 on 24.09.2015 as such the petitioner also deserves sympathetic

Patna High Court Cr.Misc. No.49443 of 2015 (2) dt.10-12-2015 consideration to which the learned APP does not oppose. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Munger in connection with Kharagpur P.S. Case No. 10 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
