The petitioner seeks bail in connection with Fulkaha P.S. Case No. 23 of 2015 registered for the offences punishable under Sections 25(1-B)a, 26 of the Arms Act.
Allegedly, seeing the police party, the petitioner started fleeing away with fire arm but after chase, threw the fire arm and succeeded in fleeing away and after search one country made Maskate loaded with live cartridge of .315 bore and 15 live cartridges kept in shocks were recovered and for that the petitioner is in custody since 01.07.2015.
In the facts and circumstances stated above, the
Patna High Court Cr.Misc. No.50908 of 2015 (3) dt.08-01-2016 2/2 petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned C.J.M., Araria arising out of Fulkaha P.S. Case No. 23 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
