JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-02-2020 Learned counsel for the petitioner seeks permission to withdraw this application in view of the stand of the respondents taken in paragraphs 6 to 9 of the counter affidavit filed on behalf of respondent no. 8 which are quoted hereinbelow :- "6. That the instant writ petition has been filed by the petitioner Shri Chandra Shekhar Pandey, Retired Teacher holder PPO No. 365243 for issuance of directions to the respondent authorities for revision of pension after granting 2nd bound promotion.
7. That in this connection, it is pertinent
Patna High Court CWJC No.18827 of 2017(2) dt.20-02-2020 2/2 to mention here that this respondent office is responsible to authorize pension/DCRG as per sanction along with service book and other pension related documents received from the department, in accordance with Bihar Pension Rule.
8. That it is stated that the pension, gratuity and commutation of pension have already been authorized by this respondent office in favour of the petitioner.
9. That it is further stated that the issue of granting promotion and ACP are released to the concerned department. However, in the light of the writ petition, the department has been requested vide this oiffice letter No. - Pen-10-61-62 dated 17.04.2018 to send the service book of the petitioner with sanctioned order if any revision of pension is required."
Permission is granted.
In view of the stand of the respondents, the writ petition is dismissed as withdrawn.
