1. Heard Mr. Anil Kumar Choudhary, learned counsel for the petitioner, Mr. Ram Chandra Prasad. Bharti, learned counsel for the informant and Mr. Tarkeshwar Nath Thakur, learned APP for the State.

2. The petitioner seeks regular bail in connection with Paliganj P.S. Case No. 57 of 2024 dated 06.02.2024 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the petitioner has been languishing in jail since 19.11.2024 having fair and clean antecedent and a false allegation has been levelled in the FIR by the informant but later, he realized his mistake and in the present time, the so-

No.9069 of 2025(3) dt.09-05-2025 2/3 called victim is residing in the petitioner's house as his wife and as per the statement of the victim recorded by her before the Judicial Magistrate, no offence as alleged in the FIR took place with her and further, she was a major girl at the time of the alleged offence and she accepted her love affair with this petitioner.

4. Learned counsel appearing for the informant accepted the aforesaid submissions made by the petitioner's counsel particularly the informant's daughter, victim, being a major girl at the time of the alleged occurrence and also, her marital relationship with this petitioner.

5. Considering the aforesaid submissions and mainly petitioner's custody period and completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Paliganj P.S. Case No. 57 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
