JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State. Despite valid service of notice, nobody appears on behalf of complainant / opposite party no. 2.
2. The petitioner, husband of the opposite party no. 2, apprehends his arrest in a case registered for the offence punishable under Sections 366A, 372, 323, 347, 354B of the Indian Penal Code and Section 67 of the I.T. Act.
3. Learned counsel for the petitioner submits that during pendency of this case, the dispute between the parties has been resolved and both of them are living together, as husband and wife. Petitioner has got clean antecedent.
4. Considering the statement made on behalf of the
Patna High Court CR. MISC. No.12975 of 2024(3) dt.16-05-2024 2/2 petitioner that both are living together, in the event of arrest or surrender within a period of six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Complaint Case No. 121-C of 2023, subject to the conditions, as laid down under Section 438(2) of the Code of Criminal Procedure.
