JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioners seek regular bail in connection with Bihariganj P.S. Case No. 277 of 2019, registered for offences punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Eleven persons are named in the First Information Report. There is allegation that one co-accused Lalo Yadav dragged the deceased and thereafter accused persons made indiscriminate firing causing the death of the husband of the Informant.

Submission of learned counsel for the petitioners is that there is allegation of firing against eleven accused persons.

Further, the petitioners have been in judicial custody since 05.09.2019 and charge-sheet has been submitted, therefore, there is no chance of tampering with the evidence.

Heard learned A.P.P. who has opposed the prayer for bail.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of concerned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 277 of 2019.
