ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 8.7.2014 in connection with Danapur P.S. Case No.311 of 2014 registered for the offences under Section 379 of the Indian Penal Code and Sections 3/4 of the Animal Cruelty Act.

It is alleged that small buffalo (Pari) was recovered from a pick-up van near the cantonment and since the petitioner is found to be in the close vicinity of the pick-up van, he has been taken into custody.

It is submitted on behalf of the petitioner that the petitioner is neither the owner of the pick-up van nor the driver nor Khalasi of the vehicle in question.

No.46667 of 2014 (2) dt.16-02-2015 2/2 Considering the aforementioned submissions and also the facts that the petitioner has been languishing in jail since 8.7.2014 and has no criminal antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur at Patna, in connection with Danapur P.S. Case No.311 of 2014.
