Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Shankarpur P.S. Case No. 51 of 2020 registered for offence punishable under sections 341, 323, 324, 427, 307, 379, 504, 506/34 of the Indian Penal Code.
At the very outset, the learned counsel for the petitioners has submitted that due to clerical mistake in the
Patna High Court CR. MISC. No.19507 of 2021(3) dt.10-03-2022 2/3 cause title, the name of police station has been mentioned as "Murliganj" in place of "Shankarpur".
Let it be rectified.
Punam Devi, the informant has lodged FIR, stating therein that the accused persons, including the present petitioners started damaging her house. On protest, they ransacked her entire house. The specific allegation against the petitioners is that they assaulted Sunil Yadav, brother-in-law of the informant.
The learned counsel for the petitioner has submitted that there is land dispute between both the parties. The injury report was called for, which has been received and annexed at flag 'R'. The doctor opined the injury as simple in nature and it has also been mentioned in the report of the doctor that the injured persons did not submit the report of CT Scan.
Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I,
Patna High Court CR. MISC. No.19507 of 2021(3) dt.10-03-2022 3/3 Madhepura in connection with Shankarpur P.S. Case No. 51 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
