In this case, petitioner is seeking bail in Mahila P.S.Case No. 151 of 2015 registered u/s 341, 323, 498A, 494 IPC. In t he present case, the lady admittedly is the wife of present petitioner and has deserted her which led to filing of the present case.

Counsel or the informant submits hat the wife is ready to live along with her husband (petitioner) but proper response is not coming from the side of petitioner. Petitioner is in custody for three months.

In the facts and circumstances of the case, petitioner Md. Nizamuddin @ Nizamuddin is directed to be released on bail

Patna High Court Cr.Misc. No.48049 of 2015 (2) dt.02-11-2015 2/2 on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Mahila P.S.Case No. 151 of 2015, subject to payment of Rs.1,000/- (one thousand) by 7th day of each calendar month. If the petitioner will fail to pay the amount as aforesaid by 7th day of each calendar month, the wife will have liberty to approach the court below and the trial court will pass appropriate order, including cancellation of bail.
