The petitioner apprehends his arrest in Paliganj P.S. Case No.337 of 2018, registered under Section 30(A) of the Bihar Prohibition and Excise Act.

The informant, ASI of Paliganj Police Station, alleged that Om Prakash Singh @ Moji Lal and Ram Kumar @ Verma Jee had kept liquor and used to sell. On such, a raid was conducted and from the house of the petitioner, 21 litres of different brands of Indian made foreign liquor was recovered. Learned counsel for the petitioner submits that petitioner was not present in his house but from perusal of the FIR itself, it appears that the house of the petitioner was searched and from his house Indian made foreign liquor was

Patna High Court Cr.Misc. No.9371 of 2019(2) dt.19-02-2019 2/2 recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
