The petitioner, namely, Raj Kumar Yadav, is in custody in Sherghati (Dobhi) P.S. Case No. 207 of 2014 under Sections 392, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submitted that coaccused, Gopal Yadav, who confessed before the police, has already been granted bail by this Court. In his confessional statement, he named this petitioner although the petitioner is not named in the F.I.R.

On the other hand, learned A.P.P. objected the prayer. It appears that the co-accused, Vinay Paswan and Gopal Yadav, have already been granted bail by this Court in Cr. Misc.

Patna High Court Cr.Misc. No.55603 of 2015 (2) dt.15-12-2015 No. 14757 of 2015 and Cr. Misc. No. 23359 of 2015, respectively. Considering the above facts and circumstances, I direct the petitioner, named above, to be released on bail on furnishing bail bond of Rs.5,000/- (Five Thousand Rupees) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Magistrate, Sherghati, Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 207 of 2014.
