The petitioner has preferred this application for grant of regular bail in connection with a case registered under sections 304B, 201 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that the accused persons tortured the daughter of the informant and ultimately she was done to death and her body disposed off. It is submitted by learned counsel for the petitioner that the petitioner who is the husband of the deceased has been falsely implicated in the case. The deceased died as a result of cholera. The informant participated in the cremation and thereafter for oblique reasons at the instance of the enemies of the petitioner has lodged this false case. The petitioner is in custody since 29.10.2020 and has no criminal antecedent.
Patna High Court CR. MISC. No.19062 of 2021(3) dt.21-10-2021 2/2 Charge sheet has been submitted in the case.
The application for bail is opposed by learned APP for the State Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner who happens to be the husband of the deceased, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
