The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. The prosecution case, in brief, is that the informant is posted as Manager, Bank of Maharashtra, Kirani Ghat Branch. On the basis of his written report, the fcase of prosecution is that the co-accused Ashok Singh produced 177 NSC for obtaining

Patna High Court CR. MISC. No.10397 of 2020(5) dt.03-06-2020 2/3 loan. The NSC was sent to the petitioner for verification which was reported to be genuine. On the basis of verification report of the petitioner, the co-accused obtained a loan of Rs. 15,000,00/- (fifteen lakhs). Thereafter, it was detected that the said NSC was forged.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 03-12-2019. Charge sheet/Prosecution report in this case has already been submitted. The NSC certificates, in question was not certified by the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 4,00,000/- (four lakhs) in the court below which shall be subject to final disposal of the case, within a period of four months.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, the petitioner is directed to be released on provisional bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Kotwali P.S. Case No. 119 of 2015.

Patna High Court CR. MISC. No.10397 of 2020(5) dt.03-06-2020 3/3 After his release, the petitioner will deposit an amount of Rs. 4,00,000/- (Four lakhs) only in the court below, which shall be subject to final disposal of the case, within a period of four months.

If the amount, in question, is deposited in the court below by the petitioner within a period of four months, learned court below shall confirm the provisional bail of the petitioner. If the petitioner fails to do so, learned court below shall be at liberty to cancel the provisional bail, granted to the petitioner. (Sudhir Singh, J) A.K.V.//- U T
