ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 20.8.2014 in connection with Bihiya P.S. Case No.22 of 2014 registered for the offences under Sections 392 and 412 of the Indian Penal Code. It is alleged by the informant that some unknown miscreants snatched away his vehicle, bearing Registration No.BR-03G-5712, and after throwing him in the ditch proceeded to run away with the vehicle towards Patna-Gaya Road. It is submitted on behalf of the petitioner that though the petitioner is not named in the F.I.R., later, on the confessional statement made by one Vikas Rai @ Champat Rai before the police, the petitioner was taken into custody. Patna High Court Cr.Misc. No.46368 of 2014 (2) dt.16-02-2015 2/2 submitted on behalf of the petitioner that said Vikas Rai has been extended the privilege of bail in Cr.Misc. No.30520 of 2014, vide order dated 6.8.2014.

Considering the fact that the case of the petitioner is also similarly situated to that of the co-accused Vikas Rai and apart from the confessional statement, there is no cogent material against him, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Bihiya P.S. Case No.22 of 2014.
