JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 392 and 411 of the Indian Penal Code. Allegation is that petitioner along with other co-accused snatched informant's mobile phone and Rs.1200/- in cash. On chase they were apprehended and on search Rs. 1200/- was recovered from the possession of co-accused, namely, Shahil. It has been submitted on behalf of the petitioner that he is in custody since 20.4.2015. He has got no criminal antecedent. There is no allegation of tampering with the evidence.

Chargesheet has been submitted in the case against the petitioner. As per prosecution case, petitioner and co-accused are said to have snatched one mobile along with Rs.1200/- from the possession of the informant. Other co-accused has been granted bail vide Cr. Misc. no. 37747 of 2015. It is further submitted that petitioner is ready to deposit an amount of Rs.2, 500/- in the court below which shall be subject to the final disposal of the case.

Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit Rs.2, 500/- in the court below which shall be subject to the final disposal of the case. Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Delha P.S. Case no. 76 of 2015.
