The petitioner seeks bail in connection with Buxar Mahila P.S. Case No.46/2023, registered for the offence punishable u/s 376, 504, 506 of the IPC and section 4 of the POCSO Act. 3.

Allegation against the petitioner is that on the pretext of marriage he established illicit physical relation with the informant but later on, he refused to marry her. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No such occurrence, in the manner as alleged, has ever taken place. He has been falsely implicated in

The medical report suggested the age of the victim between 17-18 years and same has not corroborated the prosecution case. The petitioner has no criminal antecedent and has been languishing in custody since 18.01.2024.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail by submitting that the victim is a minor and it is clear from her educational certificate, according to which, her age is 14 years. It is further submitted that the statement of the victim was recorded u/s 164 Cr.P.C., in which, she has supported the prosecution case. 6.

Considering the facts and circumstances of this case and the statement of the victim, I am not inclined to enlarge the petitioner on bail. The prayer for grant of bail on his behalf is rejected.

This application is accordingly dismissed.
