JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that on 19.3.2013 Lalan Tanti persuaded the husband of the informant to visit village Parwara to attend a dinner. Subsequently, the informant heard alarm raised by the husband but the informant went to see the dead body of her husband in a ditch with bullet injuries. The petitioner was not named in the FIR. Name of the petitioner subsequently sprang up in the statements of the wife and son of the victim to the effect that there was land dispute between the petitioner and the victim when threatening was given by the petitioner.

No.46299 of 2014 (2) dt.16-04-2015 2/2 It is submitted by the learned counsel for the petitioner that in subsequently prosecution made improvement by raisin suspicion against the petitioner and considering the suspicious nature of accusation, co accused Bhrigunandan Jha and Amit Kumar Jha have been granted anticipatory bail vide Cr. Misc. No. 37169 of 2013 taking into consideration the fact that suspicion was raised subsequently by the informant due to earlier dispute. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Tarapur P.S. Case No. 36 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
