It is informed that petitioner has already been granted privilege of bail u/S 167(2) of the Cr.P.C. by the concerned court itself.

In view of the aforesaid submission, this petition filed in connection with Pipra P.S. Case No. 243 of 2014 becomes infructuous and accordingly, this petition stands dismissed being infructuous.

However, learned Additional Chief Judicial Magistrate, Motihari, East Champaran is directed to seek an explanation from the concerned investigating officer as to under which circumstances, he failed to submit the charge sheet in Pipra P.S.
