JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 14-02-2019 The appellants seek pre-arrest bail in connection with Sadar P.S. Case No. 336 of 2018, registered for offences punishable under Sections 147, 148, 149, 152, 341, 323, 324, 307, 352, 353, 354, 427, 504, 506/34 of the Indian Penal Code and Section 3(v)(xi) of SC/ST Act.
Allegation as per F.I.R. is that when the informant along with others were preparing for worship of Bhuiya Puja, then the persons from the other community including the appellants reached there variously armed and assaulted the informant and others causing injury to them.
Submission of learned counsel for the appellants is that this is a counter blast case of a case earlier lodged by co-accused
Patna High Court CR. APP (SJ) No.531 of 2019 dt.14-02-2019 2/2 Karu Yadav, as the informant and others were trying to grab his land and so far injuries are concerned, all injuries are simple in nature, which will appear from Annexure-3.

Having heard both sides, considering the facts and circumstances of the case as stated above, let appellants, above named, be surrendered within a period of six weeks and on surrender they will release on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, Darbhanga, in connection with Sadar P.S. Case No. 336 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
Accordingly, this appeal is allowed and the impugned order is set-aside.
