JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 384, 386, 504, 506/34 and other allied sections of the Indian Penal Code. As per the prosecution case, on the order of coaccused Lal Bihari Yadav, co-accused Rajesh Yadav and Anil Yadav assaulted the informant on his head with the butt of pistol. Thereafter, all the accused persons assaulted him with fists and slaps. Co-accused Lal Bihari Yadav took away Rs.32,000/- from the pocket of the informant. Learned counsel appearing for the petitioner submits that as a matter of fact, there was dispute between the informant and the petitioner side, for the settlement of the bus stand and

Patna High Court CR. MISC. No.8764 of 2023(2) dt.24-04-2023 2/2 due to the said dispute, the petitioner has falsely been implicated in this case. No specific overt act has been alleged against the petitioner. Similarly situated co-accused has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide annexure 3.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in Sadar Police Station Case No. 68 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
