2. Petitioner is accused in a case registered for the offences under Sections 302/34 of the Penal Code, Section 3(ii)(v) of the SC/ST (Prevention of Atrocities) Act. There is omnibus allegation of assault against the petitioner. The deceased suffered head injury which, according to the petitioner, was caused due to his fall near the hand-pump.
3. Having perused the nature of injury from the post mortem report, I am satisfied that the injury could have been caused by hard blunt substance, in the present case by lathi. In the circumstances, at this stage, I am not inclined to release the petitioner on bail as he is in jail custody with effect from 06.06.2014. Application is rejected. (V.N. Sinha, J.) Rajesh/- U T
