The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
As per prosecution case, informant alleged that on 30.12.2020, while he was returning after cash collection, in the meantime, three unknown persons intercepted him and snatched total cash of Rs. 44,140/- and other articles and fled away after that this case has been lodged.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of confessional statement of co-accused Arun Sahni. Neither petitioner is named in the FIR nor he has been put on TIP.
Patna High Court CR. MISC. No.8912 of 2023(2) dt.17-04-2023 2/2 Nothing incriminating article has been recovered from his conscious possession. He has got no criminal antecedent. Similarly situated co-accused, namely, Arun Sahni has already been granted bail by a coordinate Bench of this Court vide order dated 14.02.2022 passed in Cr. Misc. No. 42833 of 2021. It is further submitted that the petitioner surrendered on 02.12.2022 and since then he is languishing in judicial custody. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kesaria P.S. Case No. 514 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari.
