The petitioner is in custody in a case registered under Sections 302 and 201 of the Indian Penal Code. It is alleged by one Vakil Ram, Chaukidar, that when on 9.3.2015 at 9.45 A.M. he reached the main road, he found a dead body of a lady lying there and police had come there. The age of the lady was 17 to 18 years and blood was coming out from the body and expressed his belief that some one had murdered the lady at some other place and threw the dead body in the water of canal.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.3.2015. Charge sheet has been

Patna High Court Cr.Misc. No.36498 of 2015 (3) dt.08-10-2015 2/2 submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. The petitioner is not manned in the FIR. Except, confessional statement, there is no other material to suggest the implication of the petitioner in the present case. On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in Nasriganj P.S.Case no. 32 05 2015.
