Petitioner is in custody in connection with Nadi (Bagaha) P.S. Case No. 35 of 2018 for the offence under sections 420, 467, 468, 34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner would submit that in the instant case 1728 of liters of liquor was seized from a pick up bolero.

Learned counsel submits that name of the petitioner was disclosed by Navin Kumar.

The petitioner is in custody since 6.9.2018.

Considering the fact that name of the petitioner was

Patna High Court Cr.Misc. No.9427 of 2019(2) dt.18-02-2019 2/2 disclosed by a person apprehended by the police and nothing was recovered from the possession of the petitioner, the court is inclined to grant bail to the petitioner but while granting the bail the court noticed the fact that in the past also he was made accused in similar cases of Excise and Prohibition Act, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Bettiah, West Champaran, in connection with Nadi (Bagaha) P.S. Case No. 35/18 subject to the condition that one of the bailors should be elected representative of the local body. (Anil Kumar Upadhyay, J) Ravi/- U T
